How to write legally defensible ARC denial letters

What a strong architectural review denial letter includes: the exact rule, the non-conforming detail, a path to approval and the owner’s appeal rights.

Updated November 5, 2026

Why vague denials fail

A denial that only says a project is “not in harmony with the community” invites disputes. Florida now requires denials to state with specificity the rule relied on and the aspect that does not conform, and Texas requires the basis to be described in reasonable detail. Even where no statute applies, specific denials are easier to defend and easier for owners to fix.

What to include

  • Owner name, address and the date the application was received.
  • A plain description of what was requested.
  • The decision: denied, or approved with conditions.
  • The exact rule — document name, section number and the relevant wording.
  • The specific part of the plan that does not conform (for example, “fence height of 8 ft exceeds the 6 ft maximum”).
  • What the owner can change to get approval.
  • Appeal or hearing rights and deadlines, where your documents or state law provide them.
  • Delivery method and date.

Mistakes to avoid

  • Relying on personal taste rather than a written standard.
  • Citing a rule that has been amended or replaced.
  • Treating similar applications differently.
  • Sending the letter after the review deadline.

How Smart-HOA-AI helps

Smart-HOA-AI drafts each letter with the cited rule and the specific non-conforming detail already filled in. The board reviews, edits and signs — a person stays accountable for every decision.

Common questions

Is “not in harmony with the community” a valid reason to deny?
In Florida it is not specific enough — denials must cite the rule and the non-conforming aspect. Everywhere, vague denials are harder to defend.
Should a denial letter explain how to get approval?
Yes. Texas requires the notice to state any changes required for approval, and it is good practice elsewhere.
How should the denial letter be delivered?
Follow your documents and state law. In Texas, by certified mail, hand delivery or electronic delivery — and record the date.
